The general conditions of sale set out below apply to all activities offered by EssaOnia-Rivières du Monde, through its brands “EssaOnia-Esprit Rafting” and “Raft In Action”, via its websites www.essaonia.com and www.raftinaction.com and its various sales outlets.
Persons wishing to participate in activities offered by EssaOnia – Rivières du Monde fully and unconditionally accept the general conditions of sale set out below.
1.PRices
The prices of our activities are indicated in €uro all taxes included (VAT + other taxes).
All activities are payable in €uro, by credit card via a link we send you, by cash or by bank transfer.
EssaOnia – Esprit Rafting reserves the right to modify its prices at any time: the activities will be invoiced on the basis of the prices displayed at the time of the activity, except for possible errors in our catalogue. Only the prices displayed on our websites www.essaonia.com and www.raftinaction.com or in our whitewater base camp in Centron are considered as reference.
Any dispute will be dealt with the only competent court.
Our prices include :
- Supervision by qualified guides,
- Specific equipment,
- The specific characteristics in case of the “all-inclusive” programmes (cf. referent quote).
Our prices do not include:
- Transfers to the meeting point of the activities,
- Personal expenses and drinks supplements,
- Specific features in case of the “all-inclusive” programmes (cf. referring quote).
Please note that for all our programmes: the transport of the participants to the departure of the river (when the meeting point is fixed at the arrival of the course) or the transport of the participants back to their vehicles at the end of the activity (when the meeting point is fixed at the departure of the course) is FREE, unless otherwise expressly announced by us.
2. Participation
Practice of all our activities requires :
- good health and no medical contraindication to the chosen activity;
- Respect for the minimum age requirements and the conditions indicated below.
In order to take part in water sports activities, it is mandatory to know how to swim at least 50 metres and to immerse yourself. A swimming certificate will be sent to you and must be filled in before the activity (parents’ signature for minors).
The practice of our activities implies that participants may get wet and/or fall into the water during the course of the activity.
For minors who are not accompanied by their parents:
It is compulsory to present a parental or collective authorisation (in the case of a collective structure) for any unaccompanied minor participating in our activities.
A swimming certificate issued by a competent authority will be requested before the activity, for each unaccompanied minor participant.
Concerning the consumption of alcoholic drinks:
The consumption of alcoholic beverages is not compatible with the practice of white water activities.
For safety reasons and to guarantee the physical integrity of all participants, the EssaOnia team guides reserve the right to refuse access to all persons showing signs of drunkenness which are not compatible with the proposed activities, without any possibility of reimbursement and/or compensation.
3. Gear provided
All specific technical gear is provided for each activity: this gear meets the current (French or European) safety standards.
A list of the personal equipment to bring with you will be given to you at the time of your registration.
4. Supervision
All of our activities are supervised by professional guides with french certificates (and some of them with international certificates). EssaOnia Sarl is working with free-lance whitewater river guides for the supervision of the whitewater activities it offers: these free-lance river guides are not employees of EssaOnia Sarl and there is no subordination link between them and EssaOnia Sarl.
all the certificates and professional cards of guides and instructors who are members of the EssaOnia-Esprit Rafting team are available on request or can be consulted at our whitewater base in Centron.
5. Safety
Each participant must refer to the instructions and safety rules issued by the guide.
Before each activity, a safety talk is given by the EssaOnia-Esprit Rafting team member river guide, presenting the use of the equipment, the safety rules to be adopted during the activity and the possible hazards inherent to the activity and to the specific environment in which the activity takes place.
Only the EssaOnia-Esprit Rafting team member can modify or cancel the trip for safety reasons related to the conditions and the level of the participants.
6. Booking and payment
Booking must be made by telephone to our offices and is subject to availability: +33 (0)6.63.08.30.16. or by email contact@essaonia.com
For all requests that have been the subject of a specific quote, booking will only be taken into account on receipt of the signed and dated quote, accompanied by a deposit of 50% of the total cost of the service. This deposit is to be paid either by bank transfer or by credit card (via a link we will send you).The balance must then be paid no later than 7 days before the D-day, stating the final number of participants.
For any request that has not been the subject of a specific and personalised quote, any booking will only be taken into account on receipt of the total amount of the service. Payment is made either by bank transfer or credit card (via a link we will send you).
Concerning the number of participants in the activities:
In the case of a group (3 people or more), the deadline for confirming us with the final number of participants in the activity is no later than 7 days before the D-day (D-7) (unless we expressly advise otherwise), at the same time of payment of the balance.
If, on the day of the activity, the number of participants is lower than the number announced on D-7 at the time of the final confirmation and payment of the balance, no refund will be made.
If the number of participants increases between the final confirmation (D-7) and the D-day, the client must contact EssaOnia as soon as possible to find out if there is still availability. The payment of additional participants must be made immediately by credit card (via a link we will send you).
By booking, you acknowledge that you have been informed of our general terms of sale and accept them.
In the case of a group or if the booking is for several persons, the subscriber undertakes to make the information and general terms of sale and all documentation known to and approved by all the participants.
7. Cancellation conditions
All the activities we offer take place in a natural environment.
Only the guides of EssaOnia – Esprit Rafting are able to cancel or postpone an activity in case of bad weather conditions that could affect the safety of the participants.
If the guides of EssaOnia – Esprit Rafting consider that the safety of the participants is not in question and that the activity can be maintained, the cancellation of the reservation or the non-appearance of the participants at the time and place of the meeting due to bad weather is equivalent to a last minute cancellation (less than 2 days before the date of the activity) and therefore entails the same consequences (see below, paragraph “Due to the client”).
By the client :
Any cancellation by you before the start of the activity must be sent to us by registered letter with acknowledgement of receipt; the date of acknowledgement of receipt of this letter will be taken as the date of cancellation for the invoicing of the cancellation fees.
In case of cancellation more than 30 days before your activity, the amounts paid will be refunded, except for a fixed sum of fifty euros (50 €) per file.
From 30 days before your activity, your withdrawal will result in the following deductions:
- from 30 to 21 days: 25% of the amount;
- from 20 to 8 days: 50% of the amount;
- 7 to 3 days: 90% of the amount;
- less than 2 days: 100% of the amount.
No refunds will be made for cancellations made less than two days in advance.
Any service interrupted or not consumed due to the participant or the subscriber, whatever the reason, will not be refundand the full price of the service must be paid.
In case of cancellation before D-15, the activity can be postponed if a date is agreed between the 2 parties.
Due to EssaOnia – Rafting Spirit:
The guides of the EssaOnia-Esprit Rafting team reserve the right to modify, with or without prior notice, any programme according to weather or safety conditions. Replacement activities may be organised without any claim for compensation from the participants.
In the event of a change in the itinerary, the EssaOnia-Esprit Rafting guides undertake to offer an itinerary of the same value as the one initially programmed; this change may be decided on the day of the activity without prior notice from us.
In the event of cancellation, another date will be agreed between the parties. If no agreement is reached, the participants will be fully refunded without being able to claim any additional compensation.
8. Insurance
EssaOnia – Esprit Rafting has a Civil Liability Insurance covering the activities it offers. Each free-lance river guide used by EssaOnia has its own professional liability policy (all these documents are available on request).
For all-inclusive programmes (activities, accommodation and meals), EssaOnia – Esprit Rafting works in close collaboration with the Annecy Aventure Agency, which holds a Tourism Authorisation issued by the Haute Savoie Prefecture and a Professional Civil Liability relating to the organisation and sale of trips or stays. The “all inclusive” programmes offered by EssaOnia-Esprit Rafting are sold through this agency and are invoiced by this agency.
It is compulsory for each participant to have individual third party liability insurance.
This is usually included in your home insurance policy, just remember to check the exclusions.
9. image rights and use of personal camera
It is possible that photos or videos are taken during the activities.
By accepting these General Conditions of Sale, the client accepts that photos or videos may be taken during their activity with ESSAONIA. Only EssaOnia – Esprit Rafting and its authorized partners are authorised to use these images for the promotion of their activities. The rights assigned to the client’s image are valid on any existing or future medium and by any existing or future process (books, brochures, guides, photos, CD-ROMs, photo CDs, DVDs, internet, etc.).
The client expressly waives any financial compensation for this authorisation.
Use of personal photo and video equipment:
It is possible to take your own photo or video equipment during our activities.
For cameras: these must be waterproof and equipped with a fastening system to avoid loss.
For on-board cameras: remember to take the necessary fasteners to fix it to our helmets. Attachment to the wrists or to a belly harness is forbidden for safety reasons.
In any case, the use of your camera is your own responsibility: EssaOnia cannot be held responsible for any loss or damage to your camera during the activity. Likewise, we cannot be held responsible for any physical damage that may be caused by your camera in the event of contact between people during the activity.
10. Equal opportunities
EssaOnia-Esprit Rafting is committed to and strives to provide equal and fair opportunities to riverguides working with us, as well as to people who come to participate in our activities, regardless of race, color, gender, national origin, religion, age, physical or mental disability, sexual orientation, etc.
Anyone who witnesses such abuse is encouraged to report it to the staff.
